Role profile:

LCH SA is an international clearing house within the Post Trade Division of LSEG, with international client outreach and fast developing complex set of businesses of critical importance. As such, LCH SA is multi regulated by three French authorities (ACPR, AMF, Banque de France), the Emir College comprising 19 European regulators and ESMA as well as by several foreign regulators (FINMA, CFTC, SEC, JFSA, ASIC, OSC, AMFQ, BOE). It is also regulated as a bank mainly by the ACPR. It has to comply with many clearing regulations such as EMIR, Dodd Frank, CCAS, MIFIR, CSDR, CCP R&R, RGAMF etc. but also banking regulations such as CRD/CRR, COMOFI, Arrêté du 3 Novembre, EBA guidelines etc.

The role of Regulators Inspection and Member Control will be hosted in LCH SA Compliance Department and report to LCH SA Chief Compliance Officer and for certain aspects directly to the CEO of LCH SA.

Key responsibilities of the role:
Regulators Inspections:

- Be the lead and central coordinator / contact point for all regulatory Inspections carried out on LCH SA (e.g ACPR, SEC etc)
- Set up a harmonised framework for regulators Inspections and examinations’ preparation, engagement, reporting, escalation, follow-up of remedial actions and ensure an efficient archiving of questions & answers; and
- Reports to the CCO

Director for Clearing Members’ Control (“CMC”)
- Holder of the CMC Card delivered by AMF;
- Acts as the chair of the Member Controls Working Group (MCWG) and acts as member of other committees of the company as relevant;
- Participates to Boards and Audit Committee as required
- Reports to the CCO or to the CEO in case the Compliance department is conflicted.
- Set-up a framework and clear processes for the management of CMC;
- Performs or ensures that the company performs the adequate controls to ensure that members comply with the rules of the CCP including:

- Know Your Customer due diligences, review of sanctions, and AML controls;
- Credit Risk assessments based on financial and operational analyses; and
- Onboarding/monitoring processes includes verifying licences, AMF authorization.
- Performs on-site or off-site investigations as required;
- Reviews, assesses the potential breaches and deciding on the breach‘s escalation, follow up, remedial action, waivers and closure and proposes actions and sanctions;
- Notify regulators, executives and relevant committees on an ongoing basis of any significant breach of the rules of the CCP and any significant issue encountered with members; and
- Draft and send to the AMF a report on the activities performed the previous yea
