Job Summary

The General Counsel reports to the President and is a member of the President’s cabinet. The General Counsel serves as the chief legal officer for the System, providing legal services on a wide range of matters.

Positions with the KCTCS System Office are term-contract positions, with the expectancy of continuance based on performance.

A hybrid work schedule considered.

Initial review of applicants will begin on August 26, . Position is open until filled.

Job Duties:

Advises the Board of Regents with respect to its governance and responsibilities and other applicable laws; oversees and/or handles all legal matters; and advises administrators, faculty, and staff on matters having legal implications for the System.

Provides legal counsel and guidance to the Board of Regents, President, and other administrators of the System on all legal matters relevant to a public institution of higher education, including Kentucky Open Meetings and Open Records law, employment law, policies, procedures, rules and regulations, real estate transactions, contracts and grants, worker’s compensation, liability and insurance matters, public monies and purchases, FERPA, Title IX, and laws pertaining to students and other laws and regulations.

Reviews, researches, interprets and prepares both written and oral opinions on a wide variety of legal issues.

Drafts and reviews policies and procedures, regulations, bylaws and other legal documents.

Review contracts, leases, other real estate transactions, and other legal documents; researches legal issues and recommends revisions as necessary.

Represents or oversees the representation of KCTCS in judicial and administrative proceedings, settlements, and in negotiations with other parties.

Selects, retains, and supervises outside counsel, as required, to obtain legal opinions or to handle claims, litigation and other matters for the System.

Manages and directs legal team in conducting legal research on complex issues on a substantial array of topics including but not limited to higher education, public procurement, governance and ethics, labor and employment, litigation oversight, immigration, intellectual property, student affairs, and real property transactions to assist in compliance with requirements.

Provides training to the System community on various legal issues.

Maintains confidentiality of client matters.

Promotes a cooperative work environment that supports equal opportunity at all levels.

Establishes and manages a budget for both inside and outside counsel.

Minimum Qualifications:

Juris Doctorate from an accredited law school and in good standing with the Kentucky Bar Association or other state bar.

Licensed or ability to obtain a license to practice law in the Commonwealth of Kentucky no later than 12 months after date of hire. Preference given to applicants with current license to practice law in Kentucky at the time of application.

Eight years of experience, preferably in higher education; prior experience as General Counsel or Associate General Counsel at another institution preferred; alternatively, experience in a Kentucky state agency.
