The Litigation Counsel will be a part of Tesla’s EMEA legal team working on all legal matters in Europe, the Middle East and Africa, ranging from commercial contracts, consumer protection and regulatory matters and related litigation. The focus for this role will be on litigation work on the French region, specifically supporting on legal matters related to the service and sales business within Tesla and advise on applicable statutory and consumer protection laws, regulatory matters, marketing, and real estate contracts as well as handling any related litigation by proactively managing outside counsel.
The role is based in Paris and/or Amsterdam.

Le Litigation Counsel fera partie de l'équipe juridique EMEA de Tesla et travaillera sur toutes les questions juridiques en Europe, au Moyen-Orient et en Afrique, qu’il s’agisse de contrats commerciaux, de la protection des consommateurs, des questions réglementaires et des litiges connexes. Le titulaire de ce poste se concentrera sur l’aspect contentieux dans la région française, en particulier sur les questions juridiques liées aux activités de service et de vente au sein de Tesla et conseillera sur les lois applicables et la protection des consommateurs, les questions réglementaires, le marketing et les contrats immobiliers ainsi que le traitement de tout litige connexe en gérant de manière proactive les avocats externes.
Le poste est basé à Paris et/ou Amsterdam.
Vous êtes très organisé, motivé, proactif et entreprenant. Vous savez faire preuve de stratégie et gérer des litiges complexes avec succès et de manière indépendante. What You’ll Do
- Drafting correspondence relating to legal issues and assisting and liaising with local teams with negotiations and correspondence from both a litigation and contractual perspective
- Maintain a database for boilerplate arguments in recurring legal issues
- Advise internal stakeholders regarding legal risks and obligations in disputes and litigation matters
- Represent Tesla in out of court negotiations and draft written agreements for B2C and B2B disputes and litigation matters and report to senior members of the legal team
- Represent Tesla in lower court proceedings in Spain and/or Portugal
- Maintain a database of all material litigation/claims matters in EMEA, specifically the Iberia region
- Provide ad hoc advice, for example on regulatory matters, marketing, and real estate contracts
Responsabilités:
- Rédiger la correspondance relative aux questions juridiques, assister et assurer la liaison avec les équipes locales dans les négociations et la correspondance tant d'un point de vue contentieux que contractuel
- Mettre à jour une base de données pour les arguments standards dans les questions juridiques récurrentes
- Conseiller les parties prenantes internes sur les risques et obligations juridiques en cas de litiges et de contentieux
- Représenter Tesla dans les négociations extrajudiciaires et rédiger des accords écrits pour les litiges B2C et B2B et faire un rapport aux membres seniors de l'équipe juridique
- Représenter Tesla dans des procédures de première instance en Espagne et/ou au Portugal
- Gérer une base de données de tous les litiges/réclamations importants dans la région EMEA, en particulier la région ibérique
- Fournir des conseils ad hoc, par exemple sur les questions réglementaires, le marketing et les contrats immobiliers
